These Terms of Service ("Terms") govern your access to and use of GradeSnap ("the Service"), operated by GradeSnap ("we," "our," or "us"). By creating an account or using the Service, you agree to be bound by these Terms.
If you are using GradeSnap on behalf of an educational institution, you represent that you are authorized to accept these Terms on that institution's behalf.
1. Service Description
GradeSnap is an AI-powered grading platform that allows teachers to upload student work — including scanned handwritten papers — and receive AI-generated grades and feedback. The Service integrates with Google Classroom and supports multiple grading modes including Auto Grade, Answer Key, and Rubric grading.
GradeSnap is intended for use by teachers and educational professionals. It is not intended to be used directly by students under 18 without teacher supervision.
2. Account Registration
To use GradeSnap, you must create an account using a valid email address or a Google account. You are responsible for:
- Providing accurate and current account information
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized account access at hello@grade-snap.com
You must be at least 18 years old to create a GradeSnap account. Accounts may not be shared between multiple individuals.
3. Acceptable Use
You agree to use GradeSnap only for lawful educational purposes. You may not:
- Upload content that violates any applicable law, including privacy laws governing student data
- Upload student work without being an authorized teacher or school official for those students
- Use the Service to harass, harm, or discriminate against students or any other individuals
- Attempt to reverse-engineer, scrape, or extract data from the Service
- Use the Service to build a competing product or service
- Share, sell, or transfer your account to another person
- Use automated scripts to access or interact with the Service without our written permission
- Upload content that contains malware, viruses, or other harmful code
We reserve the right to suspend or terminate accounts that violate these acceptable use rules, with or without notice.
4. Student Data and FERPA
You represent and warrant that you have the legal authority to upload any student data you submit to GradeSnap, and that doing so complies with applicable laws including the Family Educational Rights and Privacy Act (FERPA) and any applicable state laws.
By uploading student data, you designate GradeSnap as a "school official" under FERPA for the purposes of providing the grading service. We will not use student data for any purpose other than operating the Service as described in our Privacy Policy.
5. Subscription and Billing
Free plan
GradeSnap offers a free Starter plan with limited usage (up to 3 classes and 50 submissions per month). No credit card is required for the free plan.
Pro subscription
GradeSnap Pro is available as a monthly or annual subscription. Subscriptions are billed in advance at the start of each billing period.
Cancellation
You may cancel your Pro subscription at any time from your account Settings. Cancellation takes effect at the end of the current billing period — you retain full access until then. We do not offer prorated refunds for partial billing periods.
Refunds
If you are charged in error, contact hello@grade-snap.com within 14 days and we will issue a full refund. We may issue refunds at our discretion in other circumstances on a case-by-case basis.
Price changes
We will give you at least 30 days' notice before changing subscription prices. Continued use of the Service after the price change takes effect constitutes your acceptance of the new pricing.
School and district plans
Schools and districts may enter into separate written agreements with GradeSnap for multi-teacher or institution-wide access. Contact hello@grade-snap.com for details.
6. Intellectual Property
Your content
You retain all ownership rights in the student work and other content you upload to GradeSnap ("Your Content"). By uploading Your Content, you grant us a limited, non-exclusive license to process it solely for the purpose of providing the Service to you.
We do not claim ownership of student work, assignment rubrics, answer keys, or any other content you create or upload.
GradeSnap platform
The GradeSnap platform — including its software, user interface, algorithms, and AI models — is owned exclusively by GradeSnap and is protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, trade names, or logos without our prior written consent.
Feedback
If you submit suggestions, ideas, or feedback about GradeSnap, you grant us a perpetual, royalty-free license to use that feedback to improve the Service without any obligation to you.
7. Availability and Service Changes
We aim to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance that temporarily interrupts the Service, and we will try to do so during low-usage hours.
We reserve the right to modify, suspend, or discontinue any feature of the Service at any time. We will provide reasonable notice of significant changes that affect your use of the Service.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the AI grading results will be error-free, complete, or suitable for any particular purpose. You are solely responsible for reviewing AI-generated grades before releasing them to students or recording them in your gradebook.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRADESNAP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL — ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO GRADESNAP IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.
Some jurisdictions do not allow limitations on implied warranties or exclusions of liability for consequential damages, so the above limitations may not apply to you.
10. Indemnification
You agree to indemnify, defend, and hold harmless GradeSnap and its officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service in violation of these Terms
- Your violation of any applicable law, including student privacy laws
- Content you upload to the Service that infringes any third-party rights
- Your breach of any representation or warranty in these Terms
11. Termination
You may close your account at any time from Settings. We will delete your data in accordance with our Privacy Policy.
We may suspend or terminate your account immediately, without notice, if we determine that you have violated these Terms, engaged in fraudulent activity, or pose a risk to the security or integrity of the Service or its users.
Upon termination, your right to use the Service ends immediately. Provisions of these Terms that by their nature should survive termination — including intellectual property, limitation of liability, and indemnification — will survive.
12. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email and update the "Last updated" date at the top of this page. We will provide at least 14 days' notice before material changes take effect.
Continued use of the Service after the effective date constitutes your acceptance of the updated Terms. If you disagree with the changes, you must stop using the Service and may close your account.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. Any disputes arising from these Terms or your use of GradeSnap shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
You waive any right to participate in a class action lawsuit or class-wide arbitration against GradeSnap.
14. General
Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and GradeSnap regarding the Service and supersede all prior agreements.
Severability. If any provision of these Terms is found unenforceable, it will be severed and the remaining provisions will continue in full force.
Waiver. Our failure to enforce any provision of these Terms does not waive our right to enforce it later.
Assignment. You may not assign these Terms or your account to any third party without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
